Degree of invalidity (LAI art. 28)

Comparison between the income without health impairment and the income reasonably expected with impairment — determines the level of the AI pension.

Reference: LAI art. 28-28a

The degree of invalidity opens entitlement to:

DegreePension
40 – 49 %quarter pension
50 – 59 %half pension
60 – 69 %three-quarter pension
≥ 70 %full pension

The calculation is governed by art. 16 LPGA: comparison between the “valid income” (without impairment) and the “invalid income” (reasonably expected). Three methods apply — ordinary (working), specific (no gainful activity), mixed (working and household).

It is the most-contested area in disability insurance. See our procedure: Disability insurance claim.
